Welcome to Moments Made Clear. By submitting an order or using our services, you agree to the following Terms of Service. Please read them carefully. These terms govern the restoration, colorization, and "Reset" services provided by Moments Made Clear ("we," "us," or "our") to you ("client" or "you").
1. Service Description
Moments Made Clear provides boutique digital photo restoration and manipulation services. Unlike high-volume automated providers, we utilize human judgment, artistry, and professional tools to Restore (repair damage), Colorize (add color), and Reset (change context/background) your images. While we may use AI-assisted tools for specific tasks (e.g., noise reduction), all final artistic decisions are made by human artists to ensure emotional fidelity and realism.
2. Digital-Only Policy (No Physical Media)
IMPORTANT: Moments Made Clear is a strictly digital-only service. We do not operate a physical mail-in scanning lab.
Do Not Mail Originals: You agree not to mail physical photographs, negatives, slides, or glass plates to any address associated with Moments Made Clear.
No Liability for Mail: We accept no liability for physical items sent to us by mistake. Because we lack the facility to track, store, or return physical media, any physical packages received may be discarded without notice or liability.
3. The "Photo Manager" and Third-Party Authority
If you are submitting images on behalf of a third party (e.g., you are a professional Photo Manager or act as an agent for a client):
Warrant of Authority: You warrant that you have obtained the necessary permission and copyright authority from the owner of the image to submit it for restoration and alteration.
Indemnification: You agree to indemnify and hold Moments Made Clear harmless against any claims of copyright infringement or unauthorized use arising from your submission of images for which you did not hold proper authority.
4. The Moments Made Clear Satisfaction Guarantee
We stand behind the quality of our human-led restoration. However, because art is subjective, we structure our guarantee as a collaborative process to ensure fairness.
Collaborative Revisions: If the initial proof does not meet your expectations, you agree to provide specific feedback so we can make adjustments. We will perform up to three (3) rounds of revisions at no additional cost to correct details, color, or likeness.
Money-Back Resolution: If, after these three rounds of revisions, we are unable to deliver a restoration that meets the standards established in our initial Collaboration Plan, we will issue a 100% refund.
Effect of Refund: If a full refund is issued, you acknowledge that you hold no license or rights to use the restored digital files. You agree to delete any "Work in Progress" proofs in your possession. Moments Made Clear retains full copyright and ownership of the unpaid restoration work.
5. Cancellation & "Change of Scope"
Pre-Work Cancellation: You may cancel your order for a full refund at any time before you receive the "Project Start" notification email.
Subjectivity Disclaimer (The "Reset" Service): Our "Reset" service (moving subjects to new environments) is an artistic interpretation.
Quality Issues: If the work is technically flawed (e.g., "The lighting looks fake"), this is covered by our Satisfaction Guarantee (revisions or refund).
Stylistic Changes: If you change your mind about the concept after work has begun (e.g., "I decided I don't like the forest background we agreed on; try a beach instead"), this constitutes a New Order or a "Change of Scope" and is not grounds for a refund. We may offer a partial refund minus a 25% Kill Fee to cover the artist's labor if the project is terminated for preference reasons.
6. Asset Delivery & Final Acceptance
Proofing: During the restoration and revision process, we will provide you with watermarked, low-resolution proofs for your review.
Waiver of Refund Rights: High-resolution, un-watermarked files are released only upon your final approval. By clicking "Approve" or downloading the final high-resolution file, you waive your right to a monetary refund, as the digital good has been consumed and accepted.
7. Copyright & Usage Rights
You Retain Ownership: You (or your client) retain full copyright ownership of the original image.
Limited License: You grant us a temporary, non-exclusive license to edit, retouch, and manipulate the image solely for the purpose of fulfilling your order.
Privacy & Marketing: Unlike other providers, we will not publish, share, or use your "Before and After" images on our website, social media, or advertising without your explicit, written consent after the project is complete. Your memories remain private unless you choose to share them.
8. Data Retention
Storage: We retain your restored files and "Work in Progress" data for six (6) months after delivery to allow for re-downloads or loss prevention.
Deletion: After six months, files may be permanently deleted from our servers to ensure client privacy. We recommend you download and back up your files immediately upon delivery.
9. Prohibited Content
We reserve the right to refuse any order for any reason. We will not process content that includes:
Illegal acts, child exploitation, or non-consensual sexual content.
Hate speech or symbols.
Content that we, in our sole discretion, deem violating ethical standards.
If such content is submitted, we reserve the right to report it to relevant authorities.
10. Limitation of Liability
Service Cap: Our liability for any claim arising out of our services is strictly limited to the amount you paid for the service.
Consequential Damages: We are not liable for any consequential damages, lost profits, emotional distress, or loss of data.
